{"id":14770,"date":"2025-09-11T01:51:13","date_gmt":"2025-09-11T01:51:13","guid":{"rendered":"https:\/\/newestek.com\/?p=14770"},"modified":"2025-09-11T01:51:13","modified_gmt":"2025-09-11T01:51:13","slug":"california-two-other-states-to-come-down-hard-on-gpc-violators","status":"publish","type":"post","link":"https:\/\/newestek.com\/?p=14770","title":{"rendered":"California, two other states to come down hard on GPC violators"},"content":{"rendered":"<div>\n<div id=\"remove_no_follow\">\n<div class=\"grid grid--cols-10@md grid--cols-8@lg article-column\">\n<div class=\"col-12 col-10@md col-6@lg col-start-3@lg\">\n<div class=\"article-column__content\">\n<section class=\"wp-block-bigbite-multi-title\">\n<div class=\"container\"><\/div>\n<\/section>\n<p>US organizations are being advised to make sure they have systems in place to detect and honor Global Privacy Control (GPC) signals, as a result of the launch this week of a multi-state privacy enforcement sweep to target those who do not.<\/p>\n<p>The California Privacy Protection Agency (CPPA), as well as the attorneys general of California, Colorado, and Connecticut, announced plans on Tuesday to contact what they called \u201cbusinesses that may not be processing consumer requests to opt out of the sale of their personal information submitted via the GPC as required by law\u201d to request that those businesses comply.<\/p>\n<p>According to a <a href=\"https:\/\/cppa.ca.gov\/announcements\/2025\/20250909.html\" target=\"_blank\" rel=\"noreferrer noopener\">release<\/a> from the CPPA, the sweep \u201creinforces the three states\u2019 2025 Data Privacy Day educational efforts on the GPC,\u201d which took place at the end of January. In California, for example, it states that the <a href=\"https:\/\/www.csoonline.com\/article\/565923\/california-consumer-privacy-act-what-you-need-to-know-to-be-compliant.html\" target=\"_blank\">California Consumer Privacy Act<\/a> vests consumers with control over the personal information that businesses collect about them, and includes their right to request that businesses stop selling or sharing their personal information.<\/p>\n<p>An <a href=\"https:\/\/www.clarkhill.com\/news-events\/news\/global-privacy-controls-gpc-enforcement-sweep-coordinated-effort-by-states-on-privacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">advisory<\/a> released on Wednesday by the law firm of Clark Hill stated, \u201cthe GPC enforcement sweep does not arise in isolation. It is one of the first major initiatives to emerge from a newly formed multi-state alliance known as the <a href=\"https:\/\/cppa.ca.gov\/announcements\/2025\/20250416.html\" target=\"_blank\" rel=\"noreferrer noopener\">Consortium of Privacy Regulators<\/a>, announced via a memorandum of understanding (MOU) in April 2025. The Consortium includes privacy regulators and attorneys general from California, Connecticut, Colorado, Delaware, Indiana, New Jersey, and Oregon.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"time-to-take-immediate-action\">Time to take \u2018immediate action\u2019<\/h2>\n<p>In the advisory, lawyers <a href=\"https:\/\/www.clarkhill.com\/people\/myriah-jaworski\/\" target=\"_blank\" rel=\"noreferrer noopener\">Myria V. Jaworski<\/a>, <a href=\"https:\/\/www.clarkhill.com\/people\/chirag-patel\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chirag H. Patel<\/a> and <a href=\"https:\/\/www.clarkhill.com\/people\/ali-bloom\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ali Bloom<\/a> wrote that while each state\u2019s privacy law may differ, the MOU emphasizes that there are fundamental similarities, such as data access, data deletion, and opt-out, that should be upheld across jurisdictions.<\/p>\n<p>Defining a GPC as an opt-out preference signal (OOPS) that is built into certain browsers and extensions to allow users to automatically express their opt-out preferences, they said, \u201cthe GPC enforcement means businesses should take immediate action to evaluate whether they have systems in place to detect and honor GPCs or OOPs.\u201d<\/p>\n<p>Businesses, the advisory said, should consider several key technical and operational measures to comply that include the following steps:<\/p>\n<ul class=\"wp-block-list\">\n<li>Implement GPC signal recognition: Businesses need to update their websites and backend systems to \u201cdetect the presence of the GPC header or equivalent signals sent by browsers or browser extensions. The GPC signal is transmitted as part of the HTTP header or via JavaScript, and must be detected reliably on every relevant page where personal data is collected or sold.\u201d<\/li>\n<li>Integrate with consent management platforms (CMPs): The advisory recommended that the platforms be configured to recognize GPC signals automatically and override any conflicting consent settings or defaults that would otherwise allow data sales or sharing.<\/li>\n<li>Testing and monitoring: It said that businesses should \u201croutinely test that their systems properly detect GPC signals across browsers and devices, and monitor logs to verify that signals are being received and honored in real time.\u201d<\/li>\n<\/ul>\n<p>In addition, organizations need to update their privacy policies, the lawyers suggested, adding, \u201cprivacy notices and policies should clearly describe how the business responds to GPC signals, including the rights consumers have and the duration of the opt-out.\u201d<\/p>\n<p>Legal action for non-compliance is a distinct possibility. Recent cases involving the enforcement division of the CCPA saw clothing retailer <a href=\"https:\/\/cppa.ca.gov\/announcements\/2025\/20250506.html\" target=\"_blank\" rel=\"noreferrer noopener\">Todd Snyder<\/a> fined $345,178 for violating the state\u2019s privacy act, and <a href=\"https:\/\/cppa.ca.gov\/announcements\/2025\/20250312.html\" target=\"_blank\" rel=\"noreferrer noopener\">American Honda Motor Co.<\/a> fined $632,500 for CCPA violations, which the agency described as one of the highest fines imposed in the law\u2019s history.<\/p>\n<h2 class=\"wp-block-heading\" id=\"quasi-selected-targeting-seen-as-prudent-move\">Quasi-selected targeting seen as prudent move<\/h2>\n<p><a href=\"https:\/\/www.linkedin.com\/in\/dbshipley\/?originalSubdomain=ca\" target=\"_blank\" rel=\"noreferrer noopener\">David Shipley<\/a>, head of Canadian-based Beauceron Security, likened the move by the CPPA and the three states as the equivalent of a blitz to slow down drivers who go over the speed limit.<\/p>\n<p>The initiative, he said, is \u201cthe governance and privacy law equivalent of, \u2018let\u2019s put the California privacy Highway Patrol out there and see who\u2019s speeding, who\u2019s not actually going to play by the rules,\u2019 and it\u2019s smart. It\u2019s part of the toolkit that should be out there and done responsibly. It\u2019s done in a way that\u2019s not like \u2018we\u2019re auditing everybody.\u2019 That\u2019s terrifying \u2014 I don\u2019t think anyone has the resources for it, and it would cause mass chaos.\u201d<\/p>\n<p>But a random, or even a quasi-selected targeted enforcement initiative, he said, will actually help the privacy sector: \u201cWhat I mean by that is, there are a lot of hard working folks in in the privacy or governance, risk and compliance side, and they\u2019re going to say, \u2018hey, there\u2019s this law\u2019. And then sometimes they run into a lull at senior executive or even board levels, where people go, \u2018yes, but what\u2019s the chances we will actually get hit with it? That\u2019s a risk we\u2019re willing to accept and what\u2019s this actually going to cost us? What are the chances that this will happen versus all the other business pressures were under?\u2019\u201d<\/p>\n<p>This initiative, said Shipley, \u201cchanges the equation in people\u2019s minds, which is not a bad thing.\u201d He added that what is really needed is a national privacy agenda.<\/p>\n<p>\u201cThe United States functions the best when it acts as a united state,\u201d he said. \u201cWhat I mean by that is a national comprehensive privacy law with a single reporting mechanism and single set of standards is more cost effective for businesses that operate in multiple jurisdictions.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>US organizations are being advised to make sure they have systems in place to detect and honor Global Privacy Control (GPC) signals, as a result of the launch this week of a multi-state privacy enforcement sweep to target those who do not.
